| Summary, etc. | En 2019 a été créé, en France, le Health Data Hub (HDH), chargé de regrouper toutes les données de santé françaises. L’hébergement de ces données a été confié six mois plus tard à Microsoft, une multinationale soumise à une législation américaine peu compatible avec les règles européennes visant à leur sauvegarde et à l’indépendance de l’Union européenne. Jean-François Soupizet, prenant appui sur cette décision et ses conséquences potentielles, montre en quoi elle constitue un précédent problématique, en raison du défi plus large que constitue la maîtrise des données européennes dans un contexte dominé par les États-Unis et par la Chine. Ainsi nous alerte-t-il sur un défi majeur face auquel l’Union européenne et ses États membres ont pris un retard important par rapport à leurs concurrents, et sur les dangers qui peuvent en résulter au regard de la protection des libertés et de l’indépendance des Européens. Six months later, that data was entrusted to Microsoft, a multinational operating under US legislation that is not compatible with the European rules for safeguarding such data and maintaining EU independence. Focusing on that decision and its potential consequences, Jean-François Soupizet shows how it sets a problematic precedent because of the wider challenge represented by the control of European data in a context dominated by the USA and China. In so doing, he alerts us to a major challenge on which the EU and its member states lag significantly behind their rivals, and to the dangers that may ensue with regard to protecting the freedoms and independence of Europeans. |
