Summary, etc. | En septembre 2014, Netflix ouvre son service de vidéo à la demande par abonnement en France. L’arrivée du géant américain dans un secteur fortement régulé bouleverse les équilibres existants et suscite l’inquiétude des milieux culturels : profitant de l’hétérogénéité réglementaire en Europe, Netflix émet depuis l’étranger sans s’acquitter des nombreuses obligations qui pèsent sur les services audiovisuels français. Face à la remise en cause du modèle de soutien à la création dans l’environnement numérique, le ministère de la Culture cherche alors à le préserver à travers la promotion d’un ordre concurrentiel plus juste sur les marchés de l’audiovisuel en ligne. Mais la définition d’un modèle de concurrence subordonné à la sauvegarde de l’exception culturelle se heurte aux visions antagonistes de nombreux acteurs (autorités de régulations, entreprises privées, Commission européenne) qui soutiennent la dérégulation et la libéralisation de l’économie numérique. L’arrivée de Netflix mobilise donc le ministère en « stratège » pour imposer la prise en compte des enjeux culturels dans les politiques de concurrence. À travers le cas Netflix, l’organisation de la concurrence sur les marchés numériques apparaît comme un enjeu de luttes qui contribuent à redéfinir les logiques de l’action culturelle. |

Summary, etc. | When competition policy comes to the rescue of cultural policySince September 2014, Netflix’s subscriptions for video on demand has been available in France. The arrival of this Internet giant in a highly regulated national sector has disrupted pre-existing equilibria and has caused concern for national audiovisual and film companies : due to heterogeneous tax rules and regulations in Europe, Netflix has entered the French market without taking part in the financing of national creations and has thus challenged the existing regulatory system. The French ministry of culture has sought to preserve this system by promoting fair competition in digital markets. By making competition conditional to a respect for cultural exceptionalism, its approach has been opposed by several actors taking part in the definition of competition policies (regulatory agencies, private firms and the European Commission). On the contrary, they have advocated more deregulation and liberalization in order to implement a “free market” in the digital economy. The arrival of Netflix has therefore prompted strategic action by the Ministry of Culture in order to foster the taking into account of cultural goals in competition policies. This case reveals market competition to be the object of political struggles which have contributed to the redefinition of cultural policies. |
