| Summary, etc. | This article examines the social and political mobilization surrounding the issue of death by overwork (karôshi) and suicide by overwork (karôjisatsu) in Japan. It seeks to illuminate the influence of judicialization on various forms of public action taken to address these phenomena. These mobilizations have been organized within the legal frameworks of administrative law, civil law, social security law, and labor law. They have effectively prompted changes in these legal structures, in response to the organizational dysfunctions resulting from the increasing disparity between norms related to working time and the socio-economic transformations of Japanese society. Adopting a processual approach to the judicialization of occupational health and analyzing the diverse implementation of court decisions, this study underscores the lengthy temporal trajectory within which the recent regulation of maximum working time (2018-2020) has been embedded. |

| Summary, etc. | En analysant les mobilisations sociales et politiques du droit pour lutter contre le problème de la mort par surmenage (karôshi) et du suicide par surmenage (karôjisatsu) au Japon, cet article met en lumière l’influence de la judiciarisation sur les différentes formes d’action publique engagées pour faire face à ces phénomènes. Ces mobilisations se sont organisées dans le cadre de structures juridiques spécifiques, en droit administratif, droit civil, droit de la sécurité sociale et droit du travail, qu’elles sont parvenues, en partie, à faire évoluer pour répondre aux dysfonctionnements organisationnels suscités par le décalage croissant entre les normes du temps de travail et les transformations socioéconomiques de la société japonaise. L’approche processuelle de la judiciarisation de la santé au travail et l’analyse de la mise en œuvre plurielle des décisions de justice met en évidence la temporalité longue dans laquelle s’inscrit la récente réglementation du temps de travail maximum (2018-2020). |
