| Summary, etc. | Nombre d’établissements gériatriques malmènent encore les droits de âgés qui y résident. Des modèles classiques de la psychiatrie (I. Goffmann, J. Oury) seront convoqués afin de faire ressortir les fonctionnements «totalitaires» qui peuvent empêcher l’institution d’accomplir sa mission. La problématique du droit des âgés en institution sera traitée à partir de trois analyseurs: la plainte de l’âgé et ses destins, à commencer par la qualification de la parole qui porte cette plainte; la difficile adresse de cette plainte dans un cadre institutionnel; enfin la crainte de la rétorsion dans ses dimensions réelle et fantasmatique, cette dernière soulignant bien l’écart entre le sujet du droit et le sujet de l’insconscient. |

| Summary, etc. | OLD PEOPLE IN INSTITUTIONS, THEIR RIGHTS AND THE SUBCONSCIOUS Anumber of establishments still mishandle the rights of their elderly residents. Classical psychiatric models (I. Goffmann, J. Oury) are brought up in order to highlight “totalitarian” methods which prevent institutions from carrying out their mission. The issue of the rights of elderly people in institutions is analysed from three different angles: the complaints of the elderly and how to qualify the words expressing the complaint, the difficulty of addressing such complaints within an institution and lastly the fear of retaliation, either real or imaginary. The latter underlines the gap between a person rights and their subconscious. |
