| Summary, etc. | RésuméCet article examine l’une des causes par lesquelles la servitude aragonaise, qui s’était développée au xie siècle, décline lentement au cours des xiie et xiiie siècles. Il s’agit de l’intervention de l’État qui, au moment où il procède à la normalisation du droit, tente de définir les statuts légaux. Ce processus permet aux paysans serfs du nord de l’Aragon de réclamer devant la justice royale une condition nobiliaire qui, en même temps, équivaut à la liberté. Entre 1280 et 1300, une grande partie des paysans de cette région ont ainsi échappé à une ancienne servitude « méditerranéenne ». |

| Summary, etc. | This paper examines the slow decline of Aragonese servitude, a social form which had appeared in the xith century and focusses on State intervention throughout the xiith and xiiith centuries as one of its causes. At the time, the State was in the process of normalizing the Law and defining legal statutes. This allowed serf peasants from Northern Aragon to claim before royal tribunals a noble condition which was tantamount to freedom. Thus, from 1280 to 1300, a large proportion of the peasants of this region escaped a « Mediterranean » servitude already quite old then. |
