| Summary, etc. | RésuméL’éthique est une discipline philosophique pratique, un travail de la raison humaine, qui conduit à un questionnement pour penser les valeurs d’une action et indiquer comment agir dans le respect d’autrui et de soi-même. L’éthique appliquée est un lieu de confrontations de valeurs entrant en conflit dans une situation donnée, dans une pratique quotidienne, à propos de questions concrètes et éventuellement pour suspendre ou modifier une action. La question du diagnostic, que ce soit en médecine en général, en psychiatrie ou dans des situations cliniques particulières comme le diagnostic prénatal, est traversée par de nombreuses interrogations éthiques qui ne tombent pas du seul fait que la loi impose de le donner. Dans la mesure où cet acte médical s’inscrit dans la relation médecin-malade et qu’il interroge l’identité même de la personne malade et son histoire, le conflit éthique est là et c’est ce qui sera analysé dans cet article. |

| Summary, etc. | Ethical conflicts of diagnosis and consent: in psychiatry and prenatal diagnosisEthics is a practical philosophical discipline, a work of human reason, which leads to questioning in order to assess the values of an action and to indicate how to act in regard to others and oneself. Applied ethics allow to confront conflicting values in a given situation, as a daily practice, with respect to concrete issues and possibly in order to suspend or modify an action. The question of the diagnosis, whether it be in medicine in general, in psychiatry or in special clinical situations such as the prenatal diagnosis, is challenged by many ethical questions which do not only simply arise from the fact that the law obliges the physician to inform the patient of a given diagnosis. This is to the extent that this medical act is an integral part of the doctor-patient relationship and that it questions the very identity of the patient and their history, this is where the ethical conflict lies – and this will be analyzed in our article. |

La ética aplicada es un área de confrontaciones de valores colisionándose en determinada situación, en una práctica cotidiana, sobre cuestiones concretas y, dado el caso, para suspender o modificar una actuación. La cuestión del diagnóstico, ya sea en la medicina en general, en la psiquiatría o en situaciones particulares como el diagnóstico prenatal es un cruce de interrogaciones éticas que no se caen por su peso solo porque la ley impone comunicarlo. En la medida en que este acto médico se inscribe en la relación médico-enfermo e interroga la misma identidad de la persona enferma y su historia personal, el conflicto ético está ahí y eso es lo que se va a estudiar en este artículo. |
