| Summary, etc. | Plus de 800 000 personnes sont aujourd’hui sous mesure de protection. Ce succès du droit des (in)capacités interroge aujourd’hui les pouvoirs publics qui s’inquiètent d’une éventuelle dérive du dispositif tout en créant de nouvelles dispositions de protections comme le mandat de protection future. Cet article vise à donner quelques éléments d’éclairage relatifs au mouvement de démocratisation du droit des (in)capacités et des règles civiles et sociales d’intervention sur autrui. Pour cela, nous commençons par faire une mise en perspective historique de la définition et des usages de ce droit ; puis nous dégageons trois enjeux sociaux relatifs à la mise en œuvre effective de ce droit ; nous proposons enfin une piste de réflexion pour répondre à ces enjeux |

| Summary, etc. | Regulate the intervention regarding others. A perspective of social issues of the law on (dis)abilitiesMore than 800,000 people are now under protective care. The success of the (in) capacity law today questions government power and a concern about a possible drift while at the same time creating new protection provisions as in the case of a new mandate for future protection. This article aims to provide some enlightening elements relating to the democratization of the movement for the rights of (in) capacity, and civil and social intervention concerning others. Therefore, we began with a historical perspective of the definition and use of this right ; then we identified three social issues related to the effective implementation of this right ; we finally propose a line of inquiry in an attempt to address these issues. |

| Summary, etc. | Más de 800.000 personas hoy son objeto de una medida de protección. Este éxito del derecho de las (in)capacidades plantea una cuestión hoy a los poderes públicos que se preocupan de una posible deriva del dispositivo A la vez que están creando nuevas disposiciones de protección como por ejemplo el mandato de protección futura. Este artículo pretende dar algunos elementos de aclaración relativos al movimiento de democratización del derecho de las (in)capacidades y de las reglas civiles y sociales de intervención en otra persona. Para ello, empezamos con una puesta en perspectiva histórica de la definición y de los usos de este derecho ; luego destacamos tres retos sociales relativos a la puesta a práctica efectiva de este derecho ; proponemos por fin una pista de reflexión para responder a estos retos. |
