Summary, etc. | The recent introduction of the principle – stemming from European law – of protection of legitimate expectations in French public law does not mean that Emmanuel Lévy is vindicated. In effect, beyond the similar words, the things that they designate are very different. This article will demonstrate this. Before examining the legal and axiological foundations of the principle, I will clarify the means by which the principle of legitimate expectations protection was introduced into French public law. It will then be easy to note the clear opposition between Emmanuel Lévy’s analysis and contemporary law. |
