La règle de droit constitue un déterminant essentiel de ces choix et, par ses prescriptions, oriente le processus de décision médicale. Mais plus que dans d’autres domaines, le droit laisse aux acteurs (médecins et patients en particulier) une importante marge de manœuvre, en raison notamment de l’impossibilité pour le législateur de dicter a priori quelle est la bonne décision médicale. |
