| Summary, etc. | Introduction : Sur indication de tiers, les psychiatres sont amenés à débuter une « prise en charge » de patients qu’ils n’ont pas encore vus. Ce sont les « signalements », que les établissements doivent recueillir non seulement à des fins de description comptable de l’activité dans le cadre du PMSI, mais aussi car ces précieuses informations cliniques pourraient utilement s’intégrer à un dossier informatisé, afin de garantir la continuité des soins. Reste à savoir s’il est licite de recueillir des informations à propos d’un patient non informé de ce recueil? Méthode : Pour répondre à cette problématique, nous avons réalisé une étude approfondie des éléments juridiques existants (étude de la législation et de la jurisprudence). Résultat : La loi N?78-17 du 6 janvier 1978 n’autorisant à l’article 7 le traitement informatisé de données que si la personne concernée a donné son accord, il est interdit de recueillir des données de signalement, au nom du patient, dans un dossier informatisé. Pourtant la Loi impose aux professionnels de santé de décrire leur activité (article L.6113-7 et L.6113-8 du CSP), de garantir la continuité des soins (art. L.1110-1 du CSP) et de dispenser des soins les plus appropriés (article L.1110-5 alinéa 1 du CSP). Discussion : Nous formulons des solutions techniques conformes à l’état du droit et répondant 1) soit aux seuls impératifs du PMSI, 2) soit à ces derniers et à aux besoins d’utilisation clinique des données qui nécessitent alors une demande de dérogation auprès de la CNIL (au titre de la 3e dérogation de l’article 7 de la loi CNIL). |

| Summary, etc. | Electronic collection of reports of psychiatric disorders Introduction: Following third party indications, psychiatrics are led to take care of patients that they have not seen beforehand. These indications are called “notifications”. Hospitals are supposed to collect them not only to account for activity (in the DRG’s framework) but also to increase patient care continuity by integrating these pieces of information into an electronic medical record. Still, is it legal to collect data on a patient who is not made aware of this data collection? Method: To address this issue, we conducted an in-depth study of French legal texts (study of legislation and jurisprudence). Results: The law n?78-17 of the 6th of January 1978, at article 7, authorizes digital data treatment only if the person in case gave her consent to this. It is forbidden to collect “notifications” data with the patient name, in a digital file. Still, the law requires healthcare professionals to describe their activity (article L. 6113-7 and L. 6113-8 of the public healthcare code (CSP)), to guarantee patient care continuity (art. L.1110-1 CSP) and to give the most relevant medical care to patients (article L.1110-5 paragraph 1 of CSP). Discussion: We propose technical solutions that are in accordance with the law and 1) either meet only DRG’s requirements or 2) meet DRG’s requirements and the requirements to make use of the data for clinical purposes, which would then necessitate to call for a special dispensation by the CNIL (Data and Freedom National Commission) (according to the 3rd dispensation of article 7 of the CNIL law). |
