| Summary, etc. | RésuméLa convention sur les droits de l’homme et la biomédecine, établie sous l’égide du Conseil de l’Europe, qui a été ouverte à la signature à Oviedo en 1997 et est entrée en vigueur en 1999, a mis en place un système normatif spécifique. Elle constitue le socle d’un nouvel ordre européen de la bioéthique. Le Comité directeur pour la bioéthique (CDBI) est un véritable comité international d’éthique. Le biodroit européen, ainsi constitué, est en réalité plutôt restrictif. Une certaine ouverture s’opère toutefois avec les deux protocoles additionnels (à la convention d’Oviedo) déjà adoptés, qui reste limitée avec le premier protocole (signé en 1998 et entré en vigueur en 2001) puisqu’il porte interdiction du clonage d’êtres humains, mais qui se manifeste nettement avec le deuxième protocole (ouvert à la signature en 2002) relatif à la transplantation d’organes et de tissus d’origine humaine. |

| Summary, etc. | The Convention on Human Rights and Biomedicine, established under the aegis of the Council of Europe, which was opened for signature in Oviedo in 1997 and came into force in 1999, set up a specific normative system. It is the basis of a new European order in bioethics. The Executive Committee for Bioethics is a real international ethics committee. European biolaw, constituted in this way, is in reality rather restrictive. There is, however, a certain openness with the two additional protocols (to the Oviedo Convention) already adopted, an openness which remains limited with the first protocol (signed in 1998 and in force in 2001) since it forbids the cloning of human beings, but is much more manifest with the second protocol (open for signature in 2002) relative to the transplantation of human organs and tissues. |
