| Summary, etc. | RésuméLa complexité croissante de l’articulation des logiques scientifique et judiciaire dans les procédures pose la question de la modification de la fonction du juge qui, du rôle de décideur peut se trouver cantonné à celui de régulateur d’un mécanisme menant à une conclusion qui lui échappe. A l’opposé, le technicien acquiert, dans la même mesure, un véritable pouvoir sur le contenu de la vérité judiciaire. Il en résulte que, dans certains domaines, la connaissance scientifique tend à venir concurrencer l’exercice de l’activité juridictionnelle. Il serait cependant excessif d’en déduire une démission du juge au profit du technicien : l’application des règles processuelles aux données scientifiques assortie de l’émergence de principes directeurs de la phase scientifique permet au juge d’instrumentaliser le savoir au profit de la solution la plus juste. |

| Summary, etc. | The growing complexity of the relations between scientific and judicial logic in procedures raises the question of the modification of the function of judge who, from having a role as decision-maker can find himself restricted to the role of regulator of a mechanism leading to a conclusion which eludes him. On the other hand, the technician, to the same degree, acquires real power over the content of the judicial truth. As a result, in certain areas, scientific knowledge tends to compete with the exercising of jurisdictional activity. However, it would be excessive to deduce resignation on the part of the judge in favour of the technician: the application of the rules of trial to scientific data along with the emergence of guiding principles for the scientific phase allows the judge to instrumentalise knowledge in favour of the fairest solution. |
