| Summary, etc. | RésuméQue peut le droit face à l’avancée des biotechnologies ? Diversifiées, envahissantes mais indispensables, ces dernières appellent à un encadrement juridique qui, sans être rigide car entravant, doit cependant être suffisamment contraignant pour en contrer de trop faciles et dangereuses dérives. Le droit et les juristes se trouvent donc ici tenus d’intervenir et ce, de diverses manières. En effet, si le législateur demeure le principal acteur par l’élaboration de textes posant des principes d’action, il n’est pas le seul et ne peut puiser ses réponses dans le seul droit : des référentiels diffus tels la morale et la religion lui inspirent ses réponses, qu’elles soient textuelles ou jurisprudentielles. Les biotechnologies, domaine riche et mouvant, ne peuvent se passer d’un encadrement juridique. |

| Summary, etc. | What can the law do when faced with the progress of biotechnology? Biotechnology, diversified, pervasive but indispensable, calls for a legal framework which, without being rigid and hindering, must nevertheless be restrictive enough to counter the easy and dangerous drifts. The law and jurists find themselves obliged to intervene in various ways. Indeed, although the legislator remains the main actor through drawing up texts which pose principles for action, he is not alone and cannot draw his answers from the law alone: diffuse references like morals and religion inspire his responses, whether they be textual or jurisprudential. Biotechnology, which is a rich shifting field, cannot do without a legal framework. |
