| Summary, etc. | La loi n° 2021-1017 du 2 août 2021 permet aux enfants nés d’une procréation assistée avec tiers donneurs d’accéder, à compter de leur majorité, aux données non identifiantes et à l’identité de ce tiers. Sans remettre en question le principe de l’anonymat, consacre le droit à l’accès aux origines. Les raisons de cette évolution tiennent au à l’évolution du droit européen, qu’à une évolution logique du droit de la bioéthique français. Mais une telle consécration n’est pas sans poser de difficultés tant au plan de la mise en œuvre concrète et technique de cet accès aux origines qu’au plan des conséquences pratiques dans la réalisation de l’accès à ce droit pour les enfants bénéficiaires de ce dispositif. |

| Summary, etc. | Law n° 2021-1017 of August 2nd. 2021 allows children born of assisted reproduction with a third party donor to have access, as of their majority, to non-identifying data and the identity of this third party. Without calling into question the principle of anonymity, it enshrines the right of access to origins. The reasons for this development are to be found in the evolution of European law, rather than in a logical evolution of French bioethics law. However, such an enshrinement is not without difficulties, both in terms of the concrete and technical implementation of this access to origins and in terms of the practical consequences in the realisation of access to this right for the children benefiting from this system. |
