Summary, etc. RésuméCet article soutient que la notion de la dignité humaine, telle qu’elle est contestée actuellement, ne propose aucune direction claire aux législateurs. Au sein du « triangle bioéthique », la dignité humaine a un sens bien différent selon que l’on est utilitariste, théoricien des droits de l’homme ou défenseur de la dignité. Ayant rejeté la possibilité d’un arrangement facile de ces points de vue, nous proposons une conception de la dignité humaine comme condition préalable de (toute forme de) la communauté morale – plus précisément, un contexte dans lequel les êtres humains essayent de faire ce qui est bien et acceptent la responsabilité de leurs actions librement choisies. Si les législateurs considèrent la dignité humaine de cette façon, ils sauront s’orienter face à toute la multitude des nouvelles technologies.

Summary, etc. This paper argues that the concept of human dignity, as currently contested, offers no clear guidance to lawmakers. Within the “bioethical triangle”, human dignity has a quite different significance depending upon whether one is a utilitarian, a human rights theorist, or a dignitarian. Having rejected the possibility of an easy accommodation between these views, it is suggested that we should conceive of human dignity as a precondition for (any form of) moral community – specifically, a setting in which humans try to do the right thing and accept responsibility for their freely chosen actions. If lawmakers re-focus on human dignity in this way, they will have some important guidance in the face of a raft of emerging technologies.
