| Summary, etc. | Le réseau écologique « Natura 2000 », initié par la directive européenne du 21 mai 19921, a pour objet de contribuer à assurer la biodiversité par la conservation des habitats naturels ainsi que de la faune et de la flore sauvages sur le territoire européen des États membres. Parmi les mesures imposées aux États, figure l’obligation de réaliser une évaluation préalable d’incidences, propre à garantir qu’aucun projet ou plan ne soit autorisé dès lors qu’il est susceptible de porter une atteinte significative à un site Natura 2000. Cette notion centrale d’effets « significatifs », qui conditionne juridiquement la nécessité d’une évaluation d’incidences et la délivrance d’une autorisation, est porteuse d’une ambiguïté factuelle que l’on retrouve nécessairement sur le terrain du droit. Aussi l’administration comme le juge sont amenés à participer, inévitablement, à la définition des modalités pratiques de l’expertise. |

Expertise and biodiversity : the environmental impact assessment in the context of Natura 2000 networkNatura 2000 network, established by the Habitats directive, states that “any plan or project likely to have a significant effect on a Natura 2000 site, shall undergo an appropriate assessment to determine its implications for the site”. The safeguards set out in this article are triggered not by a certainty but by a likelihood of significant effects. The paradox clearly appears : the significant implications of a project can be assessed only through an impact assessment process. So the administration and the judge are asked, inevitably, to participate to the building of the definition of practical aspect of expertise. |
