| Summary, etc. | L’objectif de l’obligation d’information posée par le droit à la charge du médecin est de permettre au patient d’exprimer son consentement aux soins de façon libre et éclairée et d’être acteur de sa santé. Le législateur a toutefois laissé des parcelles de pouvoir particulièrement étendues faisant de l’information un instrument de pérennisation du déséquilibre du colloque médical. De surcroît, dans la pratique le médecin détient un pouvoir d’influence sur la décision du patient, parfois inconscient, souvent maîtrisé, que des travaux de sociologues ont mis en exergue. |
