| Summary, etc. | Dans le cadre du processus de décolonisation négocié dans lequel s’est engagée la Nouvelle-Calédonie, l’accord de Nouméa a exploré la voie d’un nouveau modèle de souveraineté, en reconnaissant que la souveraineté du peuple kanak est un préalable à la fondation d’une « nouvelle souveraineté, partagée dans un destin commun ». Au lendemain de la 3e consultation référendaire sur le transfert des dernières compétences régaliennes (du 12/12/2021), il paraît important d’analyser l’émergence de cette « souveraineté partagée » et de s’interroger sur son contenu et ses liens avec les notions de « décolonisation » et d’« indépendance ». Ensuite, dans le prolongement de travaux antérieurs, nous interrogeons l’hypothèse de l’émergence d’une souveraineté « îlienne » en Nouvelle-Calédonie et concluons sur les avancées du processus de décolonisation. L’originalité de notre démarche réside dans son caractère pluridisciplinaire, croisant approches juridique, politique et économique. |

| Summary, etc. | As part of New Caledonia's process of negotiated decolonization, the Noumea Agreement has explored the path to a new model of sovereignty, recognizing that the sovereignty of the Kanak people is a prerequisite for the founding of a "new sovereignty, shared in a common destiny". In the aftermath of the third referendum on the transfer of the last sovereign powers (12 December 2021), it seems important to analyse the emergence of this "shared sovereignty" and to question its content and its links with the notions of "decolonization" and "independence". Then, following on from earlier work, we review the hypothesis of an emerging “islandian” sovereignty in New Caledonia and conclude by assessing the progress of the decolonization process. The originality of our approach lies in its multidisciplinary nature, combining law, politics and economics. |
