| Summary, etc. | Le droit est une discipline vivante, évolutive, qui s’adapte à son environnement. À l’heure du big data, tout est devenu traces, les données personnelles sont désormais une des ressources essentielles de l’économie numérique. Cet article examine les raisons et les modalités de naissance du droit à l’oubli numérique, explore le contenu de ce droit subjectif et la manière dont il s’articule avec le respect de la vie privée, la liberté d’expression, les intérêts économiques des acteurs du marché et les mutations de la société. La mise en œuvre du droit à l’oubli numérique reflète les interrogations relatives à la transformation des législations nationales et à leur efficience au sein du cyberespace. Ce « nouveau droit » illustre les enjeux au cœur des différentes modifications que connaît le droit en ce début du xxie siècle et questionne l’adaptation du droit au cyberespace. |

| Summary, etc. | The law is a living and evolving discipline which adapts itself to its environment. At the time of the big data, everything becomes tracks and the personal data are, from now on, one of essential resources of the digital economy. This article examines the reasons and the birth modalities of the right to be digitally forgotten, explores the contents of this subjective law and the way it articulates with the respect of privacy, the freedom of expression, the economic interests of the market players and the transformations of the society. The implementation of the right to be digitally forgotten reflects the questioning relative to the transformation of national legislations and to their efficiency within the cyberspace. This “new law” highlights the challenges occuring in the heart of the various modifications that the law is subject to at the beginning of the XXIth century and questions its adaptation to the cyberspace. |
