| Summary, etc. | Le savoir scientifique est en principe toujours partagé et public ; à la différence des inventions techniques il est non-appropriable. Telle est la base du droit des brevets qui repose sur la distinction entre invention et découverte et demande que l’objet du brevet soit utile à quelque chose, alors que l’entreprise scientifique est – toujours en principe – dégagée de toute considération d’utilité. Toutefois, l’histoire des sciences tout comme les pratiques contemporaines montrent que la distinction entre ce qui est un bien commun partagé et ce qui est appropriable n’a rien d’évident. Le savoir scientifique est, de fait, aux mains de quelques uns. Est-ce à dire qu’il y aurait un conflit de principe entre la science et l’idéal démocratique de partage? Après avoir présenté les termes du problème, cet article suggère des pistes pour un meilleur partage des connaissances scientifiques. |

| Summary, etc. | Scientific knowledge should always be shared and public. Unlike technological inventions it is non-proprietary. Patent laws in Europe rest on a clear demarcation between invention and discovery and require that the patentable object be useful for something whereas scientific endeavour is – at least in principle – free of utilitarian purpose. However, the history of science as well as the current research practices show that the distinction between shared common knowledge and patentable results is far from obvious. Actually, scientific knowledge is and has always been in the hands of the few. Does it mean that there would be a radical antagonism between science and the democratic ideal of knowledge sharing? Following a brief presentation of the issue at stake, the paper points to potential directions for better sharing scientific knowledge. |
