| Summary, etc. | La prostitution est un sujet d’étude peu couru par les juristes. Il n’en reste pas moins qu’il illustre fort bien les difficiles rapports qu’entretiennent le droit et la morale dans le cadre d’une démocratie libérale. Au travers d’une analyse chronologique du régime juridique de la prostitution, l’article montre comment les travailleurs du sexe furent de tout temps marginalisés. D’abord confinés aux lieux clos qu’étaient les maisons de tolérance, ils furent par la suite exclus, en premier lieu, de l’espace public. Ils semblent l’être aujourd’hui de toute forme d’espace, public comme privé, et jusque de leur propre corps et de leur propre voix, puisque les acteurs de la lutte contre la prostitution leur dénient la possibilité même de s’exprimer sur leur propre situation. |

| Summary, etc. | Prostitution has not been much studied by jurists. Yet it does serve as a case in point to illustrate the difficult relationship between law and morals in the context of liberal democracy. Through a chronological analysis of the legal status of prostitution, we aim at showing how sexworkers have always been marginalized. At first secluded in closed places such as brothels, then excluded from, most importantly, the public sphere. It seems now to be the case from all kinds of spaces, public as well as private, including, symbolically, their body, since anti-prostitution activists even deny them the very possibility of expressing themselves on their own situation. |
