Summary, etc. RésuméLes entreprises font fréquemment l’objet de critiques éthiques de la part de la société civile ce qui donne lieu à de véritables campagnes de déstabilisation. Les militants qui en sont à l’origine utilisent l’arme de l’information pour dénoncer des situations qui leur paraissent révoltantes : des boycotts sont lancés, des campagnes de presse initiées, des dirigeants interpellés publiquement, etc. Toutes les grandes entreprises ont un jour ou l’autre été la cible de telles campagnes. Récemment, la critique, jusqu’alors essentiellement médiatique, s’est exprimée différemment : Des O.N.G. ont déposé des plaintes contre des entreprises. Des procédures ont débuté, parfois sur la base d’incriminations très lourdes comme « crime contre l’humanité ». Cet activisme judiciaire pourrait apparaître comme une fin en soi : faire sanctionner l’entreprise par la puissance publique et non par la société civile au travers de la dénonciation publique. Cet article démontre que la question est plus complexe et que les actions judiciaires s’insèrent dans un système de pressions informationnelles donnant une légitimité apparente à la campagne militante, en animant le réseau des organisations de la société civile et en matérialisant un conflit virtuel.

Summary, etc. Corporations are often the target of ethical criticisms from civil society, giving rise to genuine destabilisation campaigns. The militants behind these campaigns use information as a weapon to denounce situations they consider revolting: boycotts and press campaigns are launched, company directors heckled in public, etc. All large corporations have been the target of such campaigns at one time or another. In recent times, however, these criticisms made hitherto essentially through the media have been expressed differently. NGOs have brought actions against corporations, and proceedings have been started, sometimes on very serious grounds such as “crimes against humanity”. This legal activism might appear to be an end in itself: to have the corporation punished by the public authorities and not by civil society, by accusing it in public. This article demonstrates that the question is actually more complex and that this legal action is part of a system of information pressure endowing the militant campaign with apparent legitimacy, motivating the network of civil society organisations and giving material form to a virtual conflict.
