| Summary, etc. | Le risque et sa perception peuvent prendre plusieurs dimensions. La notion de prise de risque est fortement corrélée à celle de bénéfices espérés au regard d’inconvénients subis. Les décisions prises influencent la vie de l’entreprise et les risques encourus. Nous proposons une approche originale et transversale (droit et gestion) des risques pris par les créateurs et dirigeants. D’un point de vue théorique, le présent papier s’inscrit dans la continuité des travaux de Fayolle et al. (2008). Au plan méthodologique, cette étude de cas exploratoire détermine si l’entrepreneur prend des risques qu’il ne perçoit pas et qui sont susceptibles de freiner ou de mettre en danger son activité. Après un état de l’art des risques juridiques et en gestion, cette contribution développe la méthodologie et aboutit à l’élaboration d’une cartographie des risques, permettant de formuler des recommandations managériales. |

| Summary, etc. | The risk and its perception are multidimensional phenomenons. The notion of risk-taking is strongly correlated with expected benefits put in perspective by undergone inconveniences. The decisions taken can influence the life of the company and thus the incurred risks. Here is an original and transverse approach (law and management) of risks incurred by the creators and the company directors. From a theoretical point of view, the present paper uses the research of Fayolle et al. (2008). From a methodological point of view, a unique case study gives an analysis. It is a preliminary exploratory study. Our problem will be to try to know what is the taken risk, what are the size and what is the level of perception. After a presentation of literature, this contribution develops a qualitative methodology by case study. After the elaboration of a mapping of the risks incurred by the leader during the creation and the phase of growth of the company, the study formulates managerial recommendations. |
