| Summary, etc. | Résumé À travers l’étude des relations entre les autorités sanitaires européennes et les laboratoires pharmaceutiques, cet article s’attache à analyser la place et le rôle respectif de l’argumentation et de la négociation dans les échanges entre contrôleurs et contrôlés. Dans un premier temps, il indique les raisons qui poussent les autorités sanitaires à accepter des contacts avec les firmes. Dans un second temps, il analyse la nature de ces échanges. L’auteur montre que la présence forte d’intérêts particuliers n’empêche pas la mise en place d’une argumentation entre autorités et firmes. Puis, il souligne l’existence parallèle de négociations entre ces deux acteurs sur le contenu de la décision future. Ces deux formes d’interactions représentent toujours des risques d’influence, mais l’auteur souligne qu’elles peuvent contribuer à la construction de positions défendant mieux le bien commun. |

| Summary, etc. | Evidence from the case of the European regulation for pharmaceuticals is used to explore the usefulness of the distinction between negociation and argumentation to analyse the relations between regulatory authorities and regulated firms. This article firstly examines the reasons explaining the existence of direct contacts between sanitary agencies and pharmaceutical firms. It secondly shows that an argumentation can take place between these two actors, inspite of their diverging interests. It finally identifies the role of negociations in debates. The author argues that even if they represent some risks, negotiations and argumentations can help building better decisions for public health protection. |
