| Summary, etc. | Alors même que tout usager des établissements sociaux ou médico-sociaux a droit à la garantie de confidentialité des informations le concernant, les professionnels sont de plus en plus mis en situation de devoir partager des informations à caractère secret avec des interlocuteurs de plus en plus diversifiés. Où situer la limite entre obligation de se taire et nécessité de parler ? Quels critères pourraient présider à la décision ? Les repères face à cette question sont-ils les mêmes pour tous les acteurs sociaux ? Au-delà du recours au droit et à la déontologie, une réflexion éthique, tenant compte de la spécificité de chaque situation s’impose le plus souvent. Quelques problématiques liées à ce partage d’informations sont abordées ici au travers de situations concrètes soumises, pour réflexion et avis, au Comité national des avis déontologiques (CNAD) par des professionnels d’origines diverses. |

| Summary, etc. | Although every user of social or medical-social institutions is entitled to guaranteed confidentiality of information about him, professionals are increasingly placed in a situation in which they must share information of a secret character with a greater and greater variety of contacts. Where is the borderline between the obligation to remain silent and the need to speak? What criteria could govern the decision? Are the reference points in this connection for everyone in the social sector? Beyond recourse to law and professional ethics, an ethical viewpoint taking into account the specific character of each situation is most often necessary. This article discusses several issues linked to sharing of information through concrete situations which have been submitted for an assessment by professionals of various backgrounds to the National Committee of Ethical Assessments (CNAD - Comité national des avis déontologiques). |
