Summary, etc. | RésuméLa santé des salariés sur les lieux de travail est sérieusement dégradée dans nombre d’entreprises par des risques appelés psychosociaux, liés à des organisations du travail et à des méthodes de gestion. Il s’agit ici de mettre en lumière les ressources du droit, à travers ses différentes sources (directives européennes, jurisprudence, accords collectifs…) et les attributions confiées aux acteurs (information et consultation, alerte, expertise…), pour identifier les causes de ces situations et agir afin de sauvegarder la santé des salariés.Le droit français, grâce notamment aux apports du droit de l’Union européenne, offre des ressources pour évaluer ces risques et leurs causes déterminantes, assurer une prévention efficace, en appliquant les principes de prévention souvent innovants, et, à défaut, permettre la réparation, au moins partielle, des préjudices, et, aussi, sanctionner les comportements illégaux. |

Summary, etc. | The employees’ health on the place of work is seriously deteriorating in many companies because of risks called psychosocial, connected to work organizations and to management methods. Our purpose here is to bring to light the resources of the law, through its various sources (European instructions, jurisprudence, collective agreements) and the attributions of the actors (information and consultation, alert, expertise), to identify the causes of these situations and act to protect employees’ health.The French law, due to the contributions of the Law of European Union, offers resources to estimate these risks and their determining causes and insure an effective prevention, by applying the often innovative prevention principles and if not to allow the repair, at least partial, of damages and also to punish illegal behaviors. |
