| Summary, etc. | Les relations professionnelles « à la française » ont connu un profond changement de leurs règles en 2008. L’article analyse les débats qui ont conduit à cette réforme ainsi que son mode de fabrication. La réforme a été négociée entre les syndicats, le patronat et l’État, la CGT, la CFDT et le MEDEF imposant leur référentiel (ce qui n’exclut pas des visions tactiques différentes). Deux aspects de l’implémentation de la réforme – la mesure d’audience des syndicats et la transparence de leur financement – montrent que les objectifs poursuivis sont loin d’avoir été atteints. La participation aux élections professionnelles reste contrastée et décline ; le paysage syndical n’a pas été simplifié ; la transparence du financement syndical n’est qu’un formalisme ; la sous-syndicalisation perdure… Manifestement, aucun changement de fond n’est intervenu malgré le chamboulement des règles juridiques. Cela interroge sur les réalités de la « rénovation de la démocratie sociale » qui a été entreprise. |

| Summary, etc. | Industrial relations “à la française” have known a deep change of their rules in 2008. The paper analyzes the debates who explain this reform as well as its process. The reform was negotiated between labor unions, employers and the State. Two characteristics of the implementation of the reform – the measure of audience of labor unions and the transparency of their financing – show that the objectives were not reached for the moment. The participation in the professional elections remains contrasted and declines; the labor-union landscape was not simplified; the transparency of the labor-union financing is only a formalism; the sub-unionization continues… Obviously, no thorough change intervened in spite of the shake-up of the legal rules. That questions about the realities of the “renovation of the social democracy” which was committed. |
