| Summary, etc. | La Convention relative aux droits des personnes handicapées de l’ONU constitue un exemple de forum hybride au sein duquel l’expérience et l’expertise des personnes directement concernées ont été prises en compte. L’article 12 et son interprétation, qui remettent en cause la légitimité et la légalité des mesures de protection juridique, sont à cet égard particulièrement emblématiques. Prenant acte de l’absence de débats en France à ce sujet et du peu de visibilité de cette convention, un collectif de chercheurs en sciences humaines et sociales – le collectif Contrast – a décidé de favoriser le dialogue autour de l’article 12 et des mesures de protection juridique et d’impliquer des personnes directement concernées. L’organisation d’une première conférence au cours de laquelle ils ont cherché à rassembler chercheurs, professionnels et usagers a constitué l’occasion de constater la difficulté à faire participer, à égalité avec les autres, les personnes concernées. Cela a conduit une partie des chercheurs du collectif à s’interroger tant sur les limites que sur les conditions de participation des personnes en situation de handicap, et à organiser une autre conférence ainsi qu’un programme de recherche – le programme Capdroits – visant à créer les conditions de leur participation et à mettre l’ensemble des acteurs sur un pied d’égalité. Cet article constitue un récit de ces initiatives et, partant, une réflexion plus générale sur la participation des personnes en situation de handicap. |

| Summary, etc. | Participation of persons with disabilities in democratic debate: looking back on a participative approach about UN Convention on the rights of Persons with disabilitiesThe UN Convention on the rights of Persons with disabilities provides an example of a Hybrid Forum in which the experience and expertise of stakeholders have been taken into account. Article 12 and its interpretation by representatives of persons with disabilities and activists, which question the legitimacy and legality of legal protection measures, is particularly emblematic in this regard. Taking note of the absence of debates in France on this matter and little visibility of this Convention, a group of researchers in social sciences and humanities—the Collectif Contrast—decided to promote dialogue on article 12 and measures of legal protection and to involve stakeholders. The organization of the first conference in which they sought to bring together researchers, professionals and users, was an opportunity to see the difficulty of involving stakeholders on an equal basis. This led a part of the group to question both the limits and the conditions of participation of persons with disabilities, and to organise another conference and a research programme—the Capdroits programme—seeking to create the conditions for their participation and to put all actors on an equal footing. This article provides an account of these initiatives and then a more general discussion on the participation of persons with disabilities. |
