| Summary, etc. | Le cannabis en plein essor – Il s’agit d’un sujet peu commun pour une contribution en droit de la propriété intellectuelle : peut-on obtenir un monopole sur un produit qui reste qualifié de drogue et dont l’illégalité persiste dans de nombreux États ? C’est bien sûr une question qui se pose dans ce marché émergent, propice à l’activité entrepreneuriale. Dans cette contribution, nous commencerons par établir un état de la question concernant la légalité (ou plutôt l’illégalité) du cannabis en Belgique et au Luxembourg ( Point I). Dans un deuxième temps, nous rappellerons les principes de base en matière de droit européen des brevets, notamment les conditions de brevetabilité d’une invention ( Point II.B), pour ensuite dresser un exposé des inventions brevetables dans le domaine du cannabis ( Point II.C). Enfin, on examinera dans quelle mesure le respect des bonnes mœurs peut constituer un frein à la brevetabilité des inventions liées au cannabis ( Point II.D). |

| Summary, etc. | Cannabis, a booming area – This is an unusual topic for a paper on intellectual property law: can one obtain a monopoly on a product that remains qualified as a drug and which remains illegal in many States? This is of course a pertinent question in this growing market, which is conducive to entrepreneurial activity. In this paper, we will first present the state of play regarding the legality (or rather illegality) of cannabis in Belgium and in Luxembourg ( Point I ). Secondly, we will review the basic principles of European patent law, in particular the conditions of patentability of an invention ( Point II.B ), and then present the patentable inventions in the field of cannabis ( Point II.C ). Finally, we will examine the extent to which morality can constitute a restriction to the patentability of inventions related to cannabis ( Point II.D ). |
