Summary, etc. La plupart des entreprises transnationales s’engagent unilatéralement à appliquer les Principes directeurs des Nations unies de 2011. En application de ces principes et des guides interprétatifs qui les précisent, de nombreux conflits liés aux droits humains sont gérés par l’entreprise. Avec sa résolution du 28 juillet 2022, l’Assemblée générale des Nations unies considère le « droit à un environnement propre, sain et durable » comme faisant partie des droits humains. Ce faisant, l’Organisation des Nations Unies (ONU) accompagne un mouvement juridique et managérial, au travers duquel le management devient le moyen de résoudre, non seulement des conflits liés aux droits humains – entendus dans un sens restreint – mais aussi à l’environnement. Un conflit qui oppose des communautés autochtones à Glencore pour la production de charbon destiné à l’Allemagne illustre le fait que ce traitement managérial des plaintes qui concernent l’environnement permet parfois une définition plus opérationnelle du droit à l’environnement. Ces mécanismes permettent aussi un meilleur accès à la justice. La concrétisation de ces deux effets positifs n’est cependant possible que lorsque les contrôles et sanctions prévus par les autorités publiques sont effectivement appliqués.

Summary, etc. Most transnational corporations unilaterally commit to the 2011 UN Guiding Principles. In application of these principles and the interpretative guides that specify them, many human rights conflicts are managed by the company. With its resolution of 28 July 2022, the United Nations General Assembly considers the «right to a clean, healthy and sustainable environment» as a human right. In so doing, the United Nations (UN) is supporting a legal and managerial movement in which management becomes the means of resolving not only human rights conflicts - understood in a narrow sense - but also environmental conflicts. A conflict between indigenous communities and Glencore over the production of coal for Germany illustrates that this managerial handling of environmental grievances sometimes allows for a more operational definition of the right to the environment. These mechanisms also allow for better access to justice. However, both of these positive effects can only be realised if the controls and sanctions provided for by the public authorities are actually applied.
