| Summary, etc. | RésuméClassiquement, le droit ne pénètre guère l’intimité du foyer : censé régir les rapports sociaux, sa place naturelle est à l’extérieur, hors la sphère domestique. Mais, au nom du bien-être et de la sécurité, l’État-providence s’immisce de plus en plus dans l’éducation, la santé, les loisirs, le repos ou la sûreté, et donne prétexte à la loi de pénétrer les foyers. Témoignant ainsi d’une défiance croissante envers les individus, la législation domestique marque une publicisation de la question du bien individuel : l’État se trouve en charge de définir ce qui est bien pour l’individu ; il se substitue à ses choix. |

| Summary, etc. | Family LawTraditionally, the law does not enter the privacy of the home. Its function being the regulation of social relations, its natural location is outside the family sphere. Yet, in the name of welfare and security, the Welfare state has increasingly penetrated the spheres of education, health, leasure, rest or safety, which has made it possible for the law to penetrate the home. Indicating a growing mistrust of individuals, family law tends to make individual welfare a public issue. The state is put in a position to determine what is good for the individual and thus to substitute itself to the individual’s choices. |
