| Summary, etc. | RésuméCet article présente les caractéristiques et la structure constitutionnelle de la fédération australienne et explique son fonctionnement concret. Même si, selon la Constitution, ce système est fondé sur la décentralisation tant en ce qui concerne les institutions que la répartition des pouvoirs, celui-ci est devenu de plus en plus centralisé avec le temps, sous les effets de l’action du gouvernement national, des interprétations judiciaires et de la coopération intergouvernementale. Cependant le fédéralisme a toujours été et demeure encore un des éléments clés de la Constitution australienne qui, même aujourd’hui, représente un système d’équilibres et de contrepoids dans le système institutionnel. En conclusion, sont identifiées ici un certain nombre d’évolutions en cours qui, chacune, pourrait affecter la direction future du fédéralisme australien. |

| Summary, etc. | Australian Federalism and Local AutonomyThis article outlines the form and constitutional structure of the Australian federation and explains its operation in practice. It argues that, while on the face of the Constitution the federation is devolutionary in terms of both institutions and the distribution of powers, it has become progressively centralized over time, through Commonwealth action, judicial interpretation and intergovernmental co-operation. Federalism nevertheless was and is a defining feature of Australian constitutionalism that, even now, operates as a significant check and balance in the Australian constitutional system. The article concludes by identifying some pending developments, each of which has the capacity to affect the future direction that Australian federalism takes. |
