| Summary, etc. | Cet article analyse l’évolution des architectures distribuées sur Internet, et comment ces dernières peuvent relancer le débat sur certains fondements de la démocratie sur le réseau. L’article se concentre notamment sur le cas des « réseaux mesh » (mesh networking), dont l’architecture a été conçue pour répondre d’abord aux attaques des États autoritaires et à la fracture numérique, mais qui régulent aujourd’hui des formes particulières d’expression politique proches de ce qui pourrait fonder une « démocratie distribuée ». C’est à partir de ce concept que l’article s’efforcera de présenter une nouvelle façon de penser la « démocratie technique » en analysant comment les divers modes de régulation qui se sont développés sur le réseau peuvent être reliés à l’évolution des principes démocratiques. La loi traditionnellement définissait de façon descendante la manière dont les normes encadraient les infrastructures. Aujourd’hui, c’est l’architecture même des réseaux qui va déterminer les normes « techniques » qui, de façon ascendante, iront influencer les comportements des utilisateurs du réseau. |

| Summary, etc. | This article analyzes the evolution of online distributed architectures, and how these could contribute to reopening the debate on the foundations of democracy on the Internet. The article specifically focuses on the case of mesh networks, whose architecture was initially designed to counter the limitations of authoritarian states and to overcome the digital divide, but which are now being deployed to promote a particular form of political expression that could constitute the basis for “distributed democracy”. Building upon this concept, the article will investigate the potential for a more “technical democracy” by looking at the impact that new online governance models had on the evolution of democratic principles. The law traditionally defined in a top-down fashion the “legal norms” regulating a particular infrastructure. Today, it is network architecture that will determine, in a bottom-up manner, the “technical norms” that will ultimately dictate the behavior of users. |
