| Summary, etc. | La notion d’intérêt de l’enfant doit être au centre de toute décision concernant un enfant bénéficiant d’une mesure de protection. La Convention Internationale des Droits de l’Enfant ajoute le terme « supérieur » à la notion d’intérêt de l’enfant comme pour appuyer la nécessité de prendre en compte l’intérêt de l’enfant avant toute autre considération. L’intérêt de l’enfant est une notion volontairement insaisissable, aux contours flous, qui mérite d’être explicitée à la lumière de l’histoire, de la législation ainsi que du contexte socioculturel d’un pays. Nous nous attacherons à en définir les contours en gardant à l’esprit que l’enfant doit rester au cœur de tout dispositif le concernant. Ainsi, l’intérêt de l’enfant passe nécessairement au-dessus des autres intérêts et doit toujours être considéré comme supérieur. |

| Summary, etc. | The concept of the interest of the child has to be at the heart of any decision-making regarding a child under a protective measure. It can’t run counter to the notion of the “best interests” of the child, issued from the International Convention on the Rights of the Child, even though both are often compared. For more than a difference in the terminology, the content is to be substantively studied. The interest of the child is a deliberately elusive notion, with blurred contours, which deserves to be clarified in the light of a country’s historical, legislative as well as socio-cultural background. We will focus on drawing the contours of this notion, keeping in mind the idea that the child has to remain at the core of any decision-making process. The interests of the child are necessarily above other interests and will always be superior. |
