| Summary, etc. | Résumé Comment soigner un toxicomane sous obligation de soins, mesure judiciaire qui, à la différence de l’injonction thérapeutique, n’est pas une alternative à la poursuite, mais accompagne la sanction parce que le délit commis est en relation avec une toxico~manie ? Comment concilier deux domaines en apparence antago~nistes, celui, public, de la justice et celui, privé, du soin? Car si la logique judiciaire cherche à éviter la récidive, la logique du soin cherche aussi à éviter la répétition mais comme symptôme. La pratique de la justice, comme celle de la clinique, a longtemps consisté à faire comme si le soin pouvait se substituer au judiciaire, faisant ainsi oublier l’obligation et sa contrainte, ce qui rencontre aussi le désir du patient. Pour qu’une élaboration soit possible, il faut que le patient puisse clarifier ce qu’il fait pour lui et ce qu’il fait pour la justice, ce qui nécessite que le clinicien passe d’une repré~sentation duelle du soin à une relation triangulaire. Encore faut-il définir une culture commune entre les intervenants pour dissiper les malentendus, définir les attentes et ce que l’on peut soigner, fixer les limites éthiques des territoires de chacun. |

How to conciliate two apparently opposed spheres: justice, which is public; and care, which is private? While the justice system seeks to avoid the repetition of an offense, therapists seek to avoid the repetition of a symptom. For a long time, judicial and clinical practices have operated as if care could be a substitute for justice, forgetting that the constraint of obligation may run counter to the patient’s desire. For care to be effective, it is necessary for patients to clarify what they are doing for themselves, and what they are doing for the justice system. This in turn requires the practitioner to switch from a dual representation of care to a three-way relationship. A culture common to all involved (justice officers, practitioners, patients) must be defined in order to avoid misunderstandings, clarify expectations and what can be cured, and fix the ethical borders of each actor’s territory. |
