| Summary, etc. | RésuméCet article propose deux opérations de sauvetage qui sont au cœur de mon dernier ouvrage intitulé Rescuing Justice and Equality. La première partie de l'article tâche de sauver la justice du constructivisme. Elle a pour objet l'identité de la justice. La deuxième partie tâche de sauver l'égalité de la restriction à la structure de base. Elle vise le champ de la justice. La question de l'identité intervient dans mon argument contre l'identification rawlsienne de la justice aux principes désignés par les sélectionneurs constructivistes. La question du champ intervient dans mon argument contre la restriction rawlsienne de l'application des principes de justice distributive à la structure de base de la société. Les deux positions rawlsiennes critiquées ici (sur l'identité et sur-le-champs) sont, comme je l'explique dans une courte troisième partie, fondamentalement indépendantes l'une de l'autre, tout comme le sont mes arguments contre chacune d'entre elles. |

| Summary, etc. | The present paper defends two distinct rescues indicated by my recent book title, Rescuing Justice and Equality. Part One pursues the rescue of justice from constructivism. It is about the identity of justice. Part Two pursues the rescue of equality from the basic structure restriction. It is about the scope of justice. The identity question is at issue in an argument that I present against the Rawlsian identification of justice with the principles that constructivist selectors select. The scope question is at issue in an argument that I present against the Rawlsian restriction of the application of principles of distributive justice to the basic structure of society. The two Rawlsian positions (on identity and on scope) here under criticism are, as I shall explain, mainly in a very brief Part Three, substantially independent of each other, and so, too, as will be seen, are my arguments against them. |
