| Summary, etc. | La pratique du revenge porn (porno revanchard) consiste à partager ou à publier des images sexuelles privées d’autrui sans sa permission. Malgré son nom, le « revenge porn » n’est ni réellement de la pornographie, ni motivé initialement par la revanche. Cet article décrit le contexte social et les implications du revenge porn, examine dans quelle mesure les lois américaines qui s’y appliquent sont incohérentes et inadaptées, et conclut en suggérant quelques solutions à la fois, sociales, légales et technologiques susceptibles d’aider à la résolution de ce problème. Puisque le revenge porn implique d’utiliser la sexualité comme un moyen pour blesser autrui, nous affirmons qu’il s’appréhende mieux si on le considère comme une violence sexuelle dans un nouveau format numérique. |

| Summary, etc. | Revenge porn is the practice of sharing or posting another person’s private sexual images without permission. Despite the name, “revenge porn” is not really pornography nor is it primarily motivated by revenge. This article describes the social context and implications of revenge porn, examines the inconsistent and inadequate laws that exist in the US, and concludes by suggesting some social, legal, and technological solutions that might help address this issue. Because revenge porn involves using sexuality as a tool for harm, this article argues that it is best understood as sexual violence in a new digital format. |
