| Summary, etc. | L’article 1er, § 1, sous a), du règlement (CE) n° 2201/2003 du Conseil, du 27 novembre 2003, relatif à la compétence, la reconnaissance et l’exécution des décisions en matière matrimoniale et en matière de responsabilité parentale abrogeant le règlement (CE) n° 1347/2000, doit être interprété en ce sens qu’une action en annulation de mariage introduite par un tiers postérieurement au décès de l’un des époux relève du champ d’application du règlement n° 2201/2003 (1). L’article 3, § 1, sous a), cinquième et sixième tirets, du règlement n° 2201/2003 doit être interprété en ce sens qu’une personne autre que l’un des époux qui introduit une action en annulation de mariage ne peut se prévaloir des chefs de compétence prévus à ces dispositions (2). |
