| Summary, etc. | L’étude du passage de la notion d’étranger à la seigneurie à celle d’étranger au royaume permet d’appréhender la manière dont s’est développé, à partir du xive siècle, un jus soli applicable à l’ensemble du royaume. Le renforcement de l’autorité seigneuriale conduit à considérer comme étranger celui qui n’est pas né dans la seigneurie et à le désigner par différents termes. Sous l’influence des juristes médiévaux, l’ancienne notion romaine d’ origo liée au jus sanguinis disparaît au profit de la prise en compte de l’ origo propria sur laquelle repose le jus soli. Avec le développement de la souveraineté royale apparaît une nouvelle conception de l’étranger déterminée par rapport au royaume et, progressivement, les catégories médiévales disparaissent au profit de la notion moderne d’étranger. En liaison avec cette évolution, les règles féodales particulières applicables aux étrangers sont remplacées par une inaptitude testamentaire et successorale. Devenue le régime juridique de droit commun cette incapacité aboutit, dès la fin du xve siècle, à réserver au roi, par droit d’aubaine, les biens des étrangers morts dans le royaume. |

| Summary, etc. | The study of the passage of the notion of foreigner to the Lord’s domain to that of foreigner to the kingdom, enables us to get an insight into the way a jus soli, relevant to the totality of the kingdom, developed from the xivth century onwards. The reinforcement of the local Lord’s authority results in considering as foreigner any person that was not born on the domain and in designating him by specific names. Under the influence of mediaeval law scholars, the ancient Roman notion of origo connected to the jus sanguinis disappears to make way for the taking into account of the origo propria on which rests the jus soli. With the development of the king’s sovereignty a new conception of the foreigner, determined in relation to the kingdom, appears, and, progressively, the mediaeval categories disappear to be replaced by the modern notion of foreigner. Together with this evolution, the specific feudal regulations regarding the foreigners are replaced by restrictions in terms of succession and transmission of patrimony. Included in the common legal status, these restrictions lead, as early as the end of the xvth century, to reserving to the King, by right of aubaine, the full possession of the property of the foreigners deceased in the kingdom. |
