| Summary, etc. | Cet article explore les raisons pour lesquelles certains systèmes légaux occidentaux ont été traditionnellement hostiles au don. La loi privée eu égard aux transactions et échanges est généralement centrée sur le marché, avec pour conséquence une difficulté constitutive eu égard aux transactions qui ne sont pas des échanges. Afin de légiférer sur le don, la loi a dû tordre la signification de plusieurs de ses concepts. J’en conclus que certaines prohibitions légales confirment indirectement l’existence de la triple obligation de donner, recevoir et rendre. |

| Summary, etc. | “Mauss and I...”. On the Law of Gift This oral presentation of a written paper explores briefly why some Western legal systems have traditionally been hostile to gift giving. The transactional private law is generally concerned with the market and therefore fails to understand transfers that are not part of an exchange. To grasp gift giving, the law has had to distort many of its concepts. I conclude that some legal prohibitions indirectly confirm the continued existence of the obligations to give, to receive, and to reciprocate. |
