Summary, etc. | Zone entièrement militaire pendant tout le conflit, le département de la Somme a connu la violence des combats et une occupation allemande dont l’étendue territoriale a varié en fonction des événements militaires. Comment la justice pouvait-elle fonctionner dans les conditions extrêmes de la guerre ? On constate que l’exode des populations, les bombardements, les évacuations, l’interdiction ou le contrôle des déplacements, la destruction des palais de justice, le manque d’auxiliaires de justice ont rendu le fonctionnement judiciaire toujours problématique, voire impossible. Cela même si les magistrats sont restés à leur poste et si le gouvernement a modifié par décret, à de multiples reprises, le siège des juridictions, jusqu’à provoquer leur errance. |

Summary, etc. | A totally militarized zone during the whole conflict, the department of the Somme experienced the violence of the fighting and a German occupation whose territorial extent varied with the military developments. How could justice work in the extreme conditions of a war ? One can note that the exodus of the populations, the bombings, the evacuations or the control of people’s movements, the destruction of the court houses, the lack of judicial officers rendered the working of justice always problematic, when not totally impossible. And this even though the magistrates remained at their posts and the government modified by decree, in many occasions, the seat of the various jurisdictions, until this resulted in aimless wandering. |
