| Summary, etc. | A travers un modèle de course technologique, cet article étudie le mode de protection des instruments de recherche, i.e., des inventions qui, sans être associées à des profits commerciaux immédiats, facilitent la réalisation d’autres progrès technologiques. Nous montrons que paradoxalement, accorder au breveté un droit de propriété sur l’ensemble de la voie de recherche considérée (doctrine de la ligne de recherche) n’est efficace que si les coûts de RαD sont suffisamment limités et si les tribunaux peuvent traiter de manière différente des litiges identiques (i.e., appliquer des stratégies mixtes de règlement des litiges). Dans le cas contraire, il est préférable que le breveté ne perçoive qu’une redevance de licence basée sur les coûts de RαD économisés grâce à la divulgation de l’instrument de recherche (doctrine de la divulgation). |

| Summary, etc. | Patent, secrecy and technological competition This article uses a two-step technological race model to evaluate the optimal protection of new research instruments, i.e., inventions that are not directly associated to commercial profits but that facilitate further technological progress. We show that paradoxically, granting the patentee an exclusive ownership right over all the research line and related applications (prospect doctrine) is optimal only when the RαD costs are relatively low and when the courts can implement mixed strategies regarding the settlement of patent trials (thus implying that identical legal cases lead to differing outcomes). In other settings, the court should rather force the infringer to pay a license fee proportionate to the RαD savings generated by the disclosure of the research instrument (enablement doctrine). |
