| Summary, etc. | RésuméDepuis les années 1990, le principe de subsidiarité est mis en avant comme élément structurant de la construction européenne. La transcription de ce principe dans le droit n’étant pas chose aisée, il y est adjoint un second principe plus facilement transposable et opérationnel en droit : la proportionnalité. Jacques Delors, comme président de la Commission européenne, a contribué à mettre en avant et en œuvre ces principes qui tirent leur origine de la réflexion éthique des philosophes et théologiens chrétiens. Si le principe de subsidiarité est introduit dans le traité de Maastricht, le principe de proportionnalité vient l’expliciter dans le traité d’Amsterdam. |

| Summary, etc. | Since the 1990s, the principle of subsidiarity has been presented as a structural element of European construction. The transcription of this principle into law has not been easy; there is a second, adjacent principle that is more easily transposable and operational in law: proportionality. Jacques Delors, as President of the European Commission, contributed to advancing and inaugurating these principles whose origin lies in the ethical reflection of Christian philosophers and theologians. Although the principle of subsidiarity is introduced by the Maastricht Treaty, le principle de proportionality makes it more explicit in the Amsterdam treaty. |
