| Summary, etc. | RésuméL’éthique a-t-elle droit de cité dans le droit des brevets ? Certains spécialistes de la propriété industrielle s’offusquent du « mélange des genres », l’éthique devant rester à la périphérie du droit des brevets. Nous montrerons ici que l’intégration des gènes humains dans la sphère de la brevetabilité a été marquée par une montée des interrogations éthiques, exprimées par une grande diversité d’institutions, comités d’éthique, parlements, organisations scientifiques et médicales, associations de malades ou de citoyens, ou encore par des individus. Ces interrogations concernent particulièrement l’éthique de la non-commercialisation du corps humain et de ses éléments, l’étendue du consentement des personnes sur l’usage, éventuellement commercial, qui pourra être fait de leurs prélèvements, l’éthique de la libre circulation et du partage des connaissances sur le génome, l’éthique médicale et les conditions d’accès des malades et des populations, du Nord et du Sud, aux inventions génétiques. La prise en compte de certains choix éthiques, comme le statut de bien commun du génome humain ou encore le refus des monopoles dans le domaine de la santé, est susceptible de participer à la redéfinition de la norme de brevetabilité, par exemple en proposant de réserver l’attribution des brevets aux seuls procédés d’obtention ou d’utilisation des séquences génétiques tandis que celles-ci seraient désormais non brevetables. |

| Summary, etc. | Patents and ethics : controversies about the ‘patentability’ of human genesDo ethics have the right to be quoted in patents law ? Certain specialists in patent rights complain about « mixing up the issues », with ethics having to remain on the periphery of patents law. This article demonstrates that the integration of human genes into the sphere of ‘patentability’ has been accompanied by increasing ethical interrogation, illustrated by a great diversity of institutions, ethics committees, discussion groups, scientific and medical organisations, associations of patients and/or citizens, and individuals. These worries relate particularly to the ethics of the non-commercialisation of the human body and its parts ; the extent of personal assent for such usage, possibly commercial, which might be made of any parts removed ; the ethics of the free circulation and division of knowledge on the genome ; medical ethics and the conditions for access for both the sick and the populations of both the North and South, to any genetic initiatives. Taking count of certain ethical choices such as the status of common good of the human genome, or even the refusal of monopolies in the health field, is likely to form part of any redefinition of ‘patentability’ standards, for example with a proposal to reserve the attribution of patents solely to the processes for obtaining or using the genetic sequences – while these latter would now be ‘non-patentable’. |
