Summary, etc. Une étude récente, qui a connu un certain retentissement médiatique, a mis en cause le fonctionnement des jurys populaires en cour d’assises en affirmant que ceux-ci étaient influencés, dans leurs décisions, par certains reportages télévisés. Cette étude suggère ainsi que les tribunaux composés uniquement de juges professionnels seraient une garantie supérieure de justice pour les justiciables, car ne fondant pas leurs décisions sur des éléments extérieurs au procès. Toutefois, on peut se demander si les résultats de cette étude sont véritablement probants. Il s’avère en outre que cette mise en cause des décisions prises par les jurys repose sur des présupposés contestables, concernant à la fois les fonctions remplies par la peine de prison et la place des jurys populaires dans le processus judiciaire.

Summary, etc. A recent study as called into question the role of popular juries in criminal courts by claiming that the television broadcasting of crime and criminal justice stories has an influence on their decisions: sentences are supposed to be longer after more coverage of crimes and shorter after stories on criminal errors. This study suggests thus that criminal courts composed solely of professional judges would be less biased and would offer more security for the litigant. Nevertheless, on closer scrutiny, the results of this study appear less than fully convincing, since they seem to be based on questionable assumptions concerning the functions of prison sentences and the role of popular juries in the judicial process.
