| Summary, etc. | Selon la théorie Humanitaire du châtiment, punir un homme parce qu’il le mérite, et autant qu’il le mérite, est simplement de la vengeance, et par conséquent barbare et immoral. Les seuls motifs légitimes pour punir sont le désir de dissuader par l’exemple ou de corriger le criminel. Ceux qui soutiennent cette théorie pensent qu’elle est douce et miséricordieuse. En cela, je crois qu’ils se trompent gravement. Je crois que « l’humanité » dont elle se pare est une dangereuse illusion, qui dissimule la possibilité d’une cruauté et d’une injustice sans fin. J’encourage vivement le retour à la théorie traditionnelle ou Rétributive, non pas seulement, ni même principalement, dans l’intérêt de la société, mais dans l’intérêt du criminel. |

| Summary, etc. | According to the Humanitarian theory of punishment, to punish a man because he deserves it, and as much as he deserves, is mere revenge, and, therefore, barbarous and immoral. It is maintained that the only legitimate motives for punishing are the desire to deter others by example or to mend the criminal. Those who hold this theory think that it is mild and merciful. In this I believe that they are seriously mistaken. I believe that the “Humanity” which it claims is a dangerous illusion and disguises the possibility of cruelty and injustice without end. I urge a return to the traditional or Retributive theory not solely, not even primarily, in the interests of society, but in the interests of the criminal. |
