| Summary, etc. | Chacun sait que les nullités de procédures retenues trop largement nuisent à la sécurité de ces procédures jusqu’à la neutralisation complète d’un dossier pénal, mais, depuis quelques décennies, s’y ajoutent d’autres recours avec des effets encore plus dévastateurs comme l’inconventionnalité soulevée notamment devant la Cour EDH, une arme de destruction massive du droit pénal et de la procédure pénale. Également, tout aussi destructrice, la question prioritaire de constitutionnalité arguée devant le Conseil Constitutionnel, qui s’est arrogé le contrôle de compatibilité avec un étrange « bloc de constitutionnalité » comprenant la Déclaration des droits de 1789, des préambules de Constitutions et des principes qu’il découvre et déclare fondamentaux ; la violation d’un droit considéré comme fondamental neutralise alors nécessairement, directement ou indirectement, des procédures entières en leur dérobant lois d’incrimination et de répression. |

| Summary, etc. | Everyone knows that the invalidity of proceedings that are too widely retained undermines the security of these proceedings, up until the complete neutralization of a criminal case. But in recent decades other judicial paths have been added with even more devastating effects, such as the unconventionality raised in particular before the EDH Court, a weapon of mass destruction of criminal law and procedure. Also, equally destructive, is the Question Prioritaire de Constitutionnalité, argued before the Constitutional Council, which has arrogated to itself the control of compatibility with a strange “block of constitutionality” that includes the Declaration of Rights of 1789, the preambles of other Constitutions and the principles that it discovers and declares fundamental; the violation of a right considered fundamental then necessarily neutralizes, directly or indirectly, entire procedures by stealing from them laws of incrimination and repression. |
