Summary, etc. | C’est au XIXe siècle de l’Allemagne bismarckienne que vient la notion de Rechtstaat, proche de la Rule of law anglaise, toutes deux reprises en français sous le nom d’État de droit, sans grande précaution s’agissant d’univers juridiques très différents, peu compatibles avec le système romaniste dominé par la loi, où, pour paraphraser une parole célèbre, pour qu’il y ait un véritable Etat de droit, encore faut-il qu’il y ait un Etat, encore faut-il qu’il y ait un droit. Malgré ses ambiguïtés, l’État de droit connaît un essor considérable dans le vocabulaire politique et juridique, notamment dans des organismes supranationaux, Nations Unies, Conseil de l’Europe ou Union européenne qui l’utilisent comme un véritable mantra, comme une récitation sacrée, comminatoire. La conception formelle de l’État de droit assimilé à la légalité, au gouvernement des lois, à la séparation des pouvoirs, au contrôle juridictionnel de l’administration et à la sécurité juridique est trop souvent supplantée par « l’état de droits », une obligation pour l’Etat d’assurer la protection des droits de l’homme. Le double sens de l’Etat de droit a induit un double langage, de sorte qu’une clarification s’impose pour partir à la recherche de l’Etat de droit perdu. |

Summary, etc. | It was in the 19th century in Bismarckian Germany that the notion of Rechtstaat, close to the English Rule of Law, was introduced, both of which have been carelessly taken up in French under the name of État de droit, although they are very different legal universes, not very compatible with the Romanist system dominated by the law, where, to paraphrase a famous saying, for there to be a true Etat de droit, there still has to be a State, there still has to be a law. Despite its ambiguities, the rule of law is gaining considerable ground in the political and legal vocabulary, especially in supranational organizations, the United Nations, the Council of Europe or the European Union, which use it as a veritable mantra, as a sacred, comminatory recitation. The formal conception of the rule of law as legality, the government of laws, the separation of powers, the jurisdictional control of the administration and legal security is too often supplanted by the «state of rights», an obligation for the state to ensure the protection of human rights. The double meaning of the rule of law has led to a double language, so that a clarification is necessary in order to go in search of the lost rule of law. |
