| Summary, etc. | Les tristes péripéties qui ont accompagné le vote de la loi du 26 janvier 2024 dite « pour contrôler l’immigration, améliorer l’intégration » ont montré l’impossibilité désormais avérée, pour qui en douterait encore, de légiférer utilement en matière d’immigration. Un véritable barrage parfaitement coordonné et identifié a été mis en place depuis des années aussi bien dans la législation interne que dans la production normative de l’Union européenne. Mais surtout ce barrage se retrouve dans les décisions, elles aussi coordonnées, de la Cour de Justice de l’Union européenne, de la Cour européenne des droits de l’homme, du Conseil d’Etat et du Conseil constitutionnel. Ce dernier s’est particulièrement illustré à l’occasion de la loi du 26 janvier 2024, en rejetant comme étant des cavaliers législatifs des amendements parlementaires portant sur l’immigration et relatifs… à la loi « immigration ». Plus grave encore, un renforcement des pouvoirs de l’UE est en cours notamment dans toutes les matières régaliennes, y compris l’immigration, qui pourrait déboucher sur des qualifications d’atteintes aux intérêts fondamentaux de la Nation au sens des articles 410-1 et 411-5 du Code pénal. |

| Summary, etc. | The sad twists and turns that accompanied the vote on the January 26, 2024 law « to control immigration and improve integration » have shown that it is now impossible to legislate effectively on immigration. For years now, a perfectly coordinated and identified barrier has been in place, both in domestic legislation and in the normative production of the European Union. Above all, this barrier is reflected in the decisions, also coordinated, of the Court of Justice of the European Union, the European Court of Human Rights, the Conseil d’Etat and the Conseil Constitutionnel. The latter particularly illustrated itself on the occasion of the law of January 26, 2024, by rejecting as legislative riders parliamentary amendments concerning immigration and relating… to the « immigration » law. Worse still, the EU’s powers are being strengthened in all sovereign matters, including immigration, which could lead to the qualification of attacks on the fundamental interests of the Nation within the meaning of articles 410-1 and 411-5 of the French Penal Code. |
