| Summary, etc. | L’économie du droit est aujourd’hui un champ important de la théorie économique, animé par un fort pluralisme méthodologique et théorique. L’objet de l’article est de proposer une lecture raisonnée de ce pluralisme. Après avoir montré que l’économie du droit est née à la frontière de deux types de débats, ceux sur l’information et la rationalité limitée en économie et ceux sur l’interprétation en théorie du droit ; on propose une typologie des grands courants qui animent ce champ de recherche en analysant comment chacun articule d’une manière particulière une représentation de l’information en économie et une représentation de l’interprétation juridique en droit. L’enjeu de cette recherche est alors de montrer les représentations alternatives que ces courants se font de la nature de la règle de droit. |

| Summary, etc. | Cognitive Turn and Interpretive Turn in Law and EconomicsLaw and economics is nowadays one of the main fields in economic theory. However, the key aspect of contemporary law and economics is its methodological and theoretical pluralism. The article focuses on this feature and tries to explain the deep reasons of this pluralism. First of all, we show that law and economics is the heir of two main controversies in economic and in legal theory: the one about information in economics and the one about interpretative practices in law. Then it is possible to characterize the different schools of thought in law and economics by showing how information and interpretation are linked. The stakes of the paper are to show how the different schools use different representations of the nature of the legal norms. |
